LyftData Inc. (“we”, “us” or “our”) is committed to safeguarding the privacy of its users. LyftData Services include any platforms requiring Users to log in, and any other online services provided by us. LyftData Services also encompass all associated software, data, information, documentation, or materials provided to Users by us in relation to or through our services.

This Privacy Policy does not apply to third-party services, extensions, or add-ons to LyftData Services not created or provided by us, nor to websites linked from LyftData Services unless such services or websites exchange data directly with LyftData Services as an integrated part of the services. We do not control or bear responsibility for the privacy practices of third-party services or websites that fall outside the scope of LyftData Services. LyftData Services do not include social media features such as “Share” and “Like” buttons provided by third-party platforms like Facebook, Instagram, LinkedIn, and Twitter. Users are encouraged to review the privacy policies of all third-party services, software, extensions, and websites.

a) In General

We may collect data, including Personal Data, provided by Users directly to us or through our services, as well as information gathered about Users, except as otherwise described in this Privacy Policy (collectively referred to as “User Data”). Such collection may include, but is not limited to, Users inputting or uploading information into our services, information provided to us or our services by or through third-party providers or services, accessing or interacting with our services, completing forms on or through our services, and downloading software, documents, or other resources from or through our services. Additionally, we may collect information from third parties, including publicly available data from third-party websites.

User Data includes information automatically collected when visiting or otherwise accessing LyftData Services that qualifies as Personal Data (“Visitor Data”). Visitor Data specifically includes a User’s IP address, the date and time of the visit, the User’s browser and device information, details contained in cookies and tracking technologies (“cookies”), the parts of LyftData Services the User accessed or visited, internet traffic information, and data obtained from third parties, but only to the extent that such information constitutes Personal Data.

User Data does not include non-identifiable information automatically collected through accessing LyftData Services that does not constitute Personal Data (“Operational Data”). Operational Data specifically includes telemetry data received through LyftData Services, statistical data, aggregate summary data, and other information generated by LyftData Services related to their operation or performance, provided such information does not include Personal Data. This may include details such as the version, instance, and license identifier of the LyftData Services being used, as well as login dates and times, data volume usage, event counts, and the number of resources or features that are created or used.

b) Collection through LyftData Services

We may collect User Data, including Personal Data, Visitor Data, Operational Data, and any information related to our routine business operations through the use of any and all LyftData Services.

c) Collection Through Routine Business Operations

We may collect User Data, including Personal Data, as part of our routine business operations, including interactions with Users. These operations include managing business relationships, providing customer support, processing billing, conducting marketing activities, managing contracts and events, and corresponding with Users via phone, email, or other communication methods. Such information may include company name, contact details of company employees and agents, financial and payment information, purchase orders, licensing agreements, support tickets and customer support documentation, usage data related to LyftData Services, and information about Users’ administrators and end-users, which may include Personal Data.

We collect, process, store, and utilize certain information as part of LyftData Services and standard business operations. We may use User Data without limitation, provided it does not contain Personal Data or is not subject to contractual or legal restrictions that prohibit such use.

User Data may be used to comply with applicable laws, regulations, legal processes, or governmental requests, or to protect our legal rights and those of others.

We process both User Data and Operational Data, including IP addresses, to identify and resolve technical issues, monitor security, and protect our systems, events, and LyftData Services. This supports our legitimate interest in safeguarding our infrastructure and operations.

We use your User Data to respond to inquiries, fulfill requests for materials such as white papers or marketing collateral, or provide other services. For example, we may use your name and email address to deliver requested content.

To operate and improve our website, we collect data, both User Data and Operational Data, through cookies and similar technologies (with your consent, where required). We use both User Data and Operational Data to fulfill our contractual obligations in delivering LyftData Services and to support our legitimate interest in maintaining and enhancing them. Specifically, we may use this data and information to:

  1. Sharing and Disclosure of Information

We may disclose information to our subsidiaries, subject to this Privacy Policy, so they can help market, sell, and deliver LyftData Services. We are responsible for the management of jointly used Personal Data. We maintain intragroup agreements covering the use of Personal Data within our family of companies.

We may disclose information to our service providers (e.g., infrastructure as a service, order fulfillment, professional/customer/support services), pursuant to written agreements that include confidentiality, privacy, and security obligations in compliance with applicable laws.

We may disclose User Data and Operational Data to our partners and event hosts/sponsors (identified at the time of registration or event participation), pursuant to written agreements that include confidentiality, privacy, and security obligations. They may use the information to assess your interest in LyftData Services, conduct user research and surveys, or send you marketing communications, subject to the terms of their privacy policies. We may also share User Data with partners when they manage your LyftData Services for you, in compliance with applicable data protection laws.

As described further under “Cookies and Tracking Technologies”, we may disclose internet or other electronic network activity information, including, but not limited to, browsing history, search history, and information regarding your interaction with a website or advertisement if you enable or do not disable advertising and cookies, in accordance with the GDPR for European users and applicable US laws such as the CCPA for California residents.

When you take certain actions on blogs and LyftData Incorporated-branded business communication and streaming platform channels (“Online Forums”) that are public or intended to be public in nature, such as broadcasting content, participating in a chat room, posting profile information, or following a channel, that information may be collected, used, or disclosed by other participants in the Online Forums. In addition, some features of Online Forums are designed to provide others with information about user activity, such as the subscription status of users for a given channel. Users should be aware of the public nature of these forums, and data shared within them may be subject to the applicable data protection laws.

We may disclose information as necessary or appropriate under applicable laws, including laws outside your country of residence, to: comply with legal processes or requirements; respond to requests from public or government authorities (including those outside your country of residence); enforce our terms and conditions; and protect our operations, rights, and the safety of you and others, as needed.

We may disclose User Data and Operational Data in the event of a proposed or actual corporate or financing transaction, such as a reorganization, merger, sale, joint venture, acquisition, assignment, transfer, or disposition of all or any portion of LyftData Incorporated’s business, assets, or stock (including information regarding any bankruptcy or similar proceedings). For select LyftData Services, we may share information you provide, such as security artifacts that may contain Personal Data (e.g., IP address), with other subscribers, but only if required as part of the LyftData Services, as set forth in the relevant terms.

We retain your Personal Data only for as long as necessary to fulfil the purposes for which it was collected. Once those purposes are met, your information will be deleted or archived unless retention is required to comply with legal obligations or for another legitimate and lawful purpose.

We take into consideration the terms of our agreements with you, our legitimate interests, our legal obligations and the nature and volume of your Personal Data to determine the appropriate retention period.

In certain instances, we may anonymize your Personal Data so that it no longer identifies you. Once anonymized, this information may be used without further notice to you.

We do not knowingly collect, process, store, or otherwise use the Personal Data of children under sixteen years of age, nor are children under sixteen permitted to use LyftData Services. If a User provides Personal Data of children to us or our services, the User must immediately contact us at [email protected]. We will delete all such Personal Data from our services to the extent it is identifiable. If we become aware that we have received Personal Data of a child, we will notify affected Users and delete all Personal Data of the child from our services to the extent it is identifiable.
